About the DBE Program

In 1983 the United States Department of Transportation’s (DOT) Disadvantaged Business Enterprise Program (DBE Program) was created as a result of the passage of the Safe, Accountable, Flexible, and Efficient Transportation Equity Act. The program is governed by Title 49 Part 26 of the Code of Federal Regulations.  The DBE Program was created to ensure nondiscrimination in the award and administration of DOT-assisted contracts, to help create a level playing field on which DBEs can compete fairly for DOT-assisted contracts and to assist DBE firms in competing outside the DBE Program.  The DOT regulations require state and local transportation agencies who receive DOT financial assistance to establish goals for the participation of DBEs. Prime contractors must either meet the DBE goals for projects or be able to show documented evidence that good faith efforts were made to meet the DBE goals.

A similar program for airport concessions (ACDBE) was mandated by the federal government in 1987 and amended in 1992 under 49 CFR Part 23 of the Federal Code of Regulations. The ACDBE Program was created to ensure nondiscrimination in the award and administration of opportunities for concessions by airports receiving DOT financial assistance and to create a level playing field on which ACDBEs can compete fairly for opportunities for concessions.

In September of 2004 the England Economic and Industrial Development Board further expanded the DBE Program with the adoption of Board Resolution No. 143-2004 which applies existing FAA DBE Program requirements to all capital projects advertised by the England Authority.

In compliance with the above regulations the England Authority administers a DBE and an ACDBE Program. In order to participate as an eligible DBE or ACDBE on projects or contracts the regulations require a firm to be certified as a DBE and/or an ACDBE by the Louisiana Unified Certification Program (LAUCP) prior to the bid opening or proposal due date. To be certified as a DBE or ACDBE a firm must be a small business owned and controlled by socially and economically disadvantaged individuals.  The LAUCP makes certification determinations based upon on-site visits, personal interviews, reviews of licenses, stock ownership, bonding capacity, work completed, resumes of principal owners and financial capacity.
